Section 817(H) Diversification Rules and PPLIs Section 817(h) of the Internal Revenue Code requires that the investments underlying variable insurance contracts (such as variable annuities and variable life insurance) be “adequately diversified” in order to maintain favorable tax treatment. This requirement limits the composition of underlying investments by imposing specific asset allocation standards, generally restricting excessive concentration in any single security or issuer. As a result, fund managers must maintain a sufficiently broad mix of assets rather than concentrating holdings in a small number of securities or a single industry sector.
