Determining if you have official employees or just contractors

How do you know if you officially have an employee or just an independent subcontractor? There can be grey areas when it comes to determining if you have an employee or not. However, there are some criteria to help determine this. The criteria are based on things like how much control you have over the worker and their work, whether or not they get to choose their own hours, if they are providing their own tools and equipment, and if they are taking any financial risk or have ability to profit. If it is deemed that you have an employee, then the relationship and administration are treated differently than with an independent contractor.
