The Consumer Federation of America filed the complaint on April 21, 2026, in the Superior Court of the District of Columbia, on behalf of a proposed class of D.C. Facebook users. According to the filing, when Meta's internal systems flag an advertiser as up to 95% likely to be running a scam, Meta does not necessarily block the advertiser — instead, the complaint alleges Meta charges them more, through what the filing calls a "penalty bid." The complaint alleges Meta projected that more than 10% of its 2024 earnings, around $16 billion, would come from scam ads, illegal gambling, and prohibited-goods sales on its platforms. It further alleges Meta restricted its ad-vetting teams from taking any action that would cost more than 0.15% of total revenue, and that Meta ignored or incorrectly rejected 96% of valid user fraud reports each week. Meta denies the allegations. A spokesperson said the suit "misrepresents the reality of our work" and that Meta "aggressively combats scams," pointing to 159 million scam ads it says it removed last year, 92% before anyone reported them.
